На прошлой неделе произошел теракт в Нью-Йорке. Очередное скорбное событие, в результате которого пострадали люди. Человек, совершивший теракт – иммигрант, выходец из Узбекистана. Президент Трамп незамедлительно высказался в своем Твиттер аккаунте по поводу случившегося. Он заявил, что террорист в свое время выиграл грин-карту, участвуя лотерее, то есть попал в США и проживал здесь на законных основаниях. Официальное название программы – Diversity Visa Lottery или DV Lottery.
С этого начались активные слухи о том, что программу в скором времени закроют. Более того, что уже выигравшим и находящимся на стадии сбора документов или ожидания интервью, не позволят приехать в США. Чтобы унять панику необходимо понимать, что такое лотерея на грин-карту, кто и как может отменить уже существующий закон.
DV Lottery по-существу является обычной лотерей, а также одним из самых быстрых и практичных путей приобретения вида на жительство в США. Меньше чем за 2 года у людей по всему миру (за редким исключением) есть возможность в буквальном смысле выиграть постоянный статус и в последующем иметь полное право подавать документы на своих родных и близких. В отличии от других путей приобретения грин-карты, людям, выигравшим в DV Lottery, вовсе не обязательно иметь родных, проживающим в США или американского работодателя.
Далее, ежегодно Соединённые Штаты Америки выделяют 50 000 виз для розыгрыша в лотерею. Эта система направлена на привлечение в страну новых иммигрантов с целью поддержания многонациональности своего населения. Среди всех полученных заявок проводится розыгрыш. Победители получают шанс приехать на постоянное место жительства в США. Весь процесс официальный и проводится при поддержке Государственного Департамента США.
БАЗОВЫЕ КРИТЕРИИ НА УЧАСТИЕ
– Участвовать могут уроженцы всех стран, кроме Нигерии, Бангладеш, Китая (уроженцев континентальной части), Индии, Пакистана, Южной Кореи, Филиппин, Соединенного Королевства и зависимых территорий, Канады и Мексики, а также Бразилии, Колумбии, Доминиканской Республики, Сальвадора, Гаити, Ямайки и Перу.
– Заявитель должен иметь как минимум общее среднее образование или 2-летний трудовой стаж по высококвалифицированной специальности. Для этого специальность по мнению Департамента Труда должна входить в Рабочую Категорию 4 или 5 и иметь рейтинг 7.0 и выше. Проверить, является ли ваша специальность высококвалифицированной, можно тут.
Далее, чтобы стать участником лотереи, необходимо заполнить анкету с указанием биографических сведений. К анкете требуются фотографии всех членов семьи. Под семьей подразумеваются супруг(а) и ВСЕ неженатые/незамужние дети до 21 года, в том числе и от предыдущих браков.
Все просто, но есть свои технические моменты. Даже если вы выиграли в лотерею – это не гарантия переезда в США. Перед тем как получить заветную иммиграционную визу, победители должны пройти собеседование, предоставить ряд документов, включающих в себя доказательство о несудимости (или доказать, что судимость незначительная и не несет запрета на въезд в страну) и справку о полном медицинском обследование. Ограничения также касаются предыдущих нарушений визово-иммиграционных законов США, наличие социально-опасных заболеваний и общей угрозы гражданам страны. Но мучения того стоят! И не только потому, что выигравшие имеют полное право получить грин-карты на детей и супругов и въехать всей семьей в США на легальном основании, но и потому, что это позволяет получить американское гражданство через 5 лет проживания. Еще одним плюсом является факт того, что регистрация на участие в DV программе абсолютно бесплатна.
ОТМЕНЯТ ИЛИ НЕ ОТМЕНЯТ
Нападки на программу ведутся давно. Изначально DV Lottery была предложена в качестве независимого законопроекта. Позже она вошла в Закон об Иммиграции и Гражданстве США 1990 года. За годы существования лотереи свыше 1 миллиона людей со всего мира иммигрировали в Соединенные Штаты этим путем. Программа позволяет поддерживать многонациональность США, а также вносит позитивный вклад в социально-экономическое развитие страны. Поэтому, совершение преступления одним или даже двумя победителями лотереи не может и не должно стать угрозой программе в целом.
Для того чтобы изменить существующий закон, необходимо принять новый. Недавно республиканскими сенаторами на рассмотрение был вынесен законопроект под названием “RAISE Act”. Он предлагает внести существенные изменения в иммиграционную систему США. В рамках законопроекта предполагается ввести бальную систему иммиграции и значительно урезать семейные категории. К примеру, RAISE Act разрешает категории только для супругов и детей до 18 лет американских граждан и владельцев грин-карт. Все остальные категории станут недоступны. Предлагается отменить DV Лотерею и установить лимит в 50 000 беженцев. Стоит ли упоминать, что Президент Трамп активно поддерживает этот законопроект. Для того, чтобы он стал законом необходимо полное согласие не только обеих партий, но и обеих палат Конгресса. А этого в ближайшее время не предвидится, поскольку RAISE Act у многих вызывает вопросы и не предлагает достойной замены существующей системе. Вместо того чтобы отменять DV Лотерею и урезать семейные категории, нам всем нужно сфокусироваться на решение проблемы дабы избежать последующих атак и защитить весь Американский народ от недоброжелателей, независимо от их происхождения и места рождения. Не будем забывать, что благополучие США зиждется на иммигрантах!
