Ждать у моря погоды или вооружиться официальными сроками рассмотрения документов?

После обращения в иммиграционную службу за той или иной услугой каждый заявитель мучается вопросом, когда ждать решения по делу. Сегодня, мы бы хотели обратить ваше внимание на обновлённые таблицы сроков рассмотрения иммиграционных заявлений.

Время рассмотрения заявлений регулярно обновляется иммиграционной службой

Сайт иммиграционной службы www.uscis.gov регулярно опубликовывает таблицы, показывающие приблизительное время рассмотрения по каждой категории дел с разбивкой по разным офисам относительно существующей юрисдикции. Узнать, какой офис занимается рассмотрением, можно взглянув на уведомление о принятии дела к производству, содержащему номер дела (Receipt Notice). На днях были опубликованы обновленные таблицы по состоянию на 31 октября 2017 (см. ниже).

Для кого это информация может быть полезной?

  • Если вы собираетесь подавать иммиграционное заявление и хотите знать примерное время рассмотрения.
  • Если дело было направлено в иммиграционную службу и находится на рассмотрении продолжительное количество времени.
  • Если суд рассматривает ваше дело о депортации и вам необходимо предоставить процессуальные сроки о рассматриваемом деле в суд,
  • A также в иных случаях.

Анализируя таблицы, обратите внимание, что во-первых, сроки рассмотрения одних и тех же категорий дел могут отличаться в зависимости от офиса, а во-вторых,  дела отличаются по под-категориям. Самое простое – офисы в Калифорнии и в Техасе могут одновременно рассматривать  петиции граждан США на братьев и сестер (I-130) и время будет кардинально отличаться (19 мая 2011 – Калифорния и 24 января 2017 – Техас ); или если Вы отправили форму I-539 на продление туристического статуса (B-2), те сроки, что указаны по I-539, поданных на смену статуса на студенческий (F-1), вам не подходят.

Помните, что если ваше дело находится за пределами времени, указанного в таблице, вы имеете право на подачу заявки о статусе дела (Service Request). Для этого необходимо обратиться в иммиграционную службу по телефонному номеру 1-800-375-5283 или путем оформления электронной заявки по ссылке. При заполнении заявки выбираете опцию “Case Outside of Normal Processing Time”. После заполнения вы получите подтверждающий номер, начинающийся буквами SR (Service Request). Не забудьте распечатать или сохранить в электронном виде страницу с номером, она может понадобиться в дальнейшем. В идеале, в течении 30 дней вы получите решение по делу. Но чаще всего вам либо пришлют формальное письмо о том, что дело рассматривается и вам необходимо запастись терпением либо не пришлют ничего. На этом этапе воспользуйтесь услугой Infopass. Пройдя по ссылке, вы можете выбрать дату и время вашего визита  в местный иммиграционный офис. На встречу с иммиграционным офицером возьмите копию вашего файла, уведомление о принятии дела к производству, и распечатку подтверждения, что вы подали заявку электронно. С определенной долей настойчивости и знаний основ иммиграционного производства большинство дел можно сдвинуть с мертвой точки.
