НЕ СТАТЬ ЖЕРТВОЙ ИММИГРАЦИОННЫХ КОНСУЛЬТАНТОВ, ПОМОЩНИКОВ И ПРОЧИХ МОШЕННИКОВ

На мой взгляд, произошла уникальная история, поскольку «добро» победило, и «зло» было повержено. Уникальность ситуации придает не то чтобы победа добра, а скорее то, что зло в данном контексте – это шарлатаны, которые под маской «специалистов» предлагали незаконные иммиграционные услуги. Чаще всего, подобные ситуации замалчиваются. К счастью, не в этом случае.

Иммиграционные мошенники получат заслуженное наказание

В феврале 2015 года, Мария (настоящее имя не распространяется по причинам безопасности) и ее муж обратились за помощью (по наводке жены практикующего) к некоему гражданину Дельгадо, который вел скромную «юридическую» практику в рамках своего турагентства Del Travel. Мария – гражданка США – собиралась ходатайствовать о получении вида на жительство (а/к/а грин-карта) для своего мужа. Дельгадо заверил Марию, что дело их плевое и адвокат не понадобится, что он знаток дела с достаточно внушительным списком побед в подобных делах и заслуживает доверия. Он также убедил семью, что гран-карту муж получит без всяких проблем, находясь в Штатах.

Заручившись доверием Марии и ее мужа и, что немаловажно, их финансовой поддержкой, Дельгадо возомнил себя иммиграционным адвокатом и начал раздавать советы по поводу того, какие формы необходимы для достижения их цели, собирать информацию и выстраивать дело. Он заполнил формы I-130, I-485 и I-134, благословил дело на удачу и отправил его в иммиграционную службу. Но удача – штука коварная.

Месяцем позже, к удивлению пары, им пришел запрос от властей, требующий прислать форму I-864 вместо I-134, а также доказательства легального въезда мужа в страну. Поскольку муж перешел границу нелегально, доказательств на руках не оказалось, что привело к последующему отказу и потенциальному переводу дела в иммиграционный суд и депортации. Дельгадо не знал о нюансах иммиграционного права (это и понятно) и о том, как муж Марии приехал в страну спросить не удосужился. Мария обратилась к иммиграционному адвокату, который в свою очередь тщетно пытался решить вопрос с Дельгадо мирным путем. Адвокат подал иск в суд с просьбой возместить убытки пары. Перескакивая через нагромождение юридических процессов – Мария и ее муж выиграли дело и получили солидную компенсацию.

Итак, “notarios”, консультанты по визам, иммиграционные консультанты и прочие шарлатаны, убеждающие вас в своей компетенции НЕ ЯВЛЯЮТСЯ ИММИГРАЦИОННЫМИ АДВОКАТАМИ. Соответственно, они не имеют права давать юридические советы, представлять интересы клиентов в суде и в работе с иммиграционной службой.

На основании правил, установленных Департаментом Юстиции «О Признании Организаций и Аккредитации Представителей» от 20 декабря 2016 года, для предоставления услуг в сфере иммиграционного права необходима официальная аккредитация. Причем выдается она на основании заявления и тщательной проверки Управлением Программ Правового Доступа при Департаменте Юстиции. Если уж вы решили в силу определенных причин обратиться к не-адвокату за иммиграционной помощью – будьте бдительны и требуйте документы, подтверждающие аккредитацию.

Штаты по-разному защищают своих резидентов от подобных мошенников. В приведенном выше деле, Дельгадо действовал вопреки закону штата Вашингтон «О Предупреждении Мошенничества в Сфере Иммиграционных Услуг». В рамках этого нормативного акта наряду с прочими ограничениями запрещается рекламировать себя в качестве “notario”, указывать на необходимость заполнения тех или иных форм, не говоря уже о том, чтобы давать юридические советы.

К сведению, в штате Джорджия существует закон, обязующий иммиграционных ассистентов получить лицензию на предоставление иммиграционного сопровождения. Более того, закон содержит детальное определение иммиграционного сопровождения – любая услуга за вознаграждение, относящаяся к сфере иммиграции ЗА ИСКЛЮЧЕНИЕМ(!) дачи юридического совета, юридических рекомендаций по делу или иной помощи, требующей юридического анализа, принятия юридического решения или интерпретации закона. То есть, такой ассистент имеет право внести информацию в форму, которую ВЫ самостоятельно обозначили, не более. Все остальное противоречит текущему законодательству.

Более того, в США предусмотрена виза для жертв определенных преступлений (U Visa). В некоторых случаях вы не только вернете свои деньги, но и сможете получить статус.
